1. Acceptance of Terms
Welcome to KidTalks Public Speaking Academy (hereafter referred to as "KidTalks Academy"). By accessing or using our website, courses, and services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, please do not use our services.
Minors: If you are under the age of majority in your state (typically 18 years old), a parent or legal guardian must review and agree to these Terms of Use on your behalf before you can use our services. By allowing your child to use KidTalks Academy, you agree to be bound by these terms and to be responsible for your child's use of our services.
2. Description of Service
KidTalks Academy provides online public speaking courses and educational materials designed for children and young adults. Our services include video lessons, downloadable resources, exercises, and certification program.
3. User Accounts
To access certain features of our service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring that the information you provide is accurate and up-to-date
Account Sharing Prohibited: Your login credentials are personal and confidential. You may not share your user name, password or account access with any person who is not a member of your immediate household. Each user must have their own individual account. Account sharing violates these terms and may result in immediate termination of your account without refund.
Parents or legal guardians must create and manage accounts for children under 13 years of age.
4. Course Access and Enrollment
Upon successful payment, you will receive access to the enrolled course(s). Course access includes:
- Unlimited streaming of course video content during your access period
- Access to course materials for online viewing only
- Access to course updates and improvements
Course access is granted for personal use only and may not be shared with others. Downloading, recording, or reproducing any course content with any person outside of your immediate household is strictly prohibited. We reserve the right to revoke access if we detect account sharing, unauthorized downloads, or other violations of these terms.
5. Payment and Cancellations
All payments are processed securely through our payment provider. Course fees are charged at the time of enrollment. All sales are final, except where required by applicable law. By purchasing a course, you acknowledge and agree that refunds are handled on a case-by-case basis at the sole discretion of KidTalks Academy.
Accidental Purchases: If you believe you made a purchase in error, you may contact us within 48 hours of the transaction for consideration of a refund, provided you have not accessed or used any course materials. Refunds will be made by check and mailed within 21 days of notification.
6. Intellectual Property Rights
All content provided through KidTalks Academy, including but not limited to videos, student workbooks, instructor handbooks, worksheets, exercises, graphics, text, and logos, is the property of KidTalks Academy or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, distribute, or create derivative works from our content
- Share your account login credentials or course access with others
- Download, record, screen capture, or reproduce course videos or materials in any format except where authorized
- Use our content for commercial purposes without written permission
- Circumvent any technological measures designed to protect our content
7. User Content and License
Our courses may allow you to submit content such as speeches, scripts, videos, exercises, or other materials ("User Content"). By submitting User Content, you (and your parent or legal guardian, if you are a minor) grant KidTalks Academy a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content solely for the purposes of:
- Operating and providing the services (including grading and feedback)
- Improving our courses and educational materials
- Technical administration and support
You represent and warrant that:
- You own or have the necessary rights to all User Content you submit
- Your User Content does not infringe any third-party intellectual property rights
- Your User Content complies with these Terms of Use and applicable laws
We reserve the right to remove any User Content that violates these terms, is inappropriate, or for any other reason at our sole discretion.
8. User Conduct
You agree to use our services in a lawful and respectful manner. You may not:
- Upload or transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems or other user accounts
- Interfere with the proper functioning of the website or services
- Use our services for any illegal or unauthorized purpose
- Impersonate any person or entity
9. Children's Privacy and Parental Consent (COPPA Compliance)
Our courses are designed for children and young adults. The collection and use of personal information — especially for children under 13 — is governed by our Privacy Policy and the Children's Online Privacy Protection Act (COPPA).
Information We Collect from Children Under 13:
- Name and email address (collected from parent/guardian)
- Course progress and completion data
- Submitted assignments and course work
Verifiable Parental Consent: Before collecting, using, or disclosing any personal information from children under 13, we require verifiable parental consent. Parents must create and manage accounts on behalf of children under 13. By creating an account for your child, you provide consent for the collection and use of your child's information as described in our Privacy Policy.
Parental Rights: Parents and legal guardians have the right to:
- Review the personal information collected from their child
- Request deletion of their child's personal information
- Refuse to allow further collection or use of their child's information
- Revoke consent at any time by contacting us
We collect only the information reasonably necessary for your child to participate in our courses. We do not condition participation on the child providing more personal information than is reasonably necessary. We retain children's information only for as long as necessary to provide the services or as required by law.
Parental Supervision: We require that:
- Parents or legal guardians review and approve course content before enrollment
- Parents provide appropriate supervision during course participation
- Parents are responsible for ensuring their child's compliance with these terms

10. Certification
Upon successful completion of the course and upon receiving a passing score on a speech submission, students will receive an award certificate. Certificates are for acknowledgement of achievement purposes only and do not represent professional credentials or qualifications.
11. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- Our services will be uninterrupted, secure, or error-free
- Course content will meet your specific requirements or expectations
- Any particular results will be achieved through use of our courses
12. Limitation of Liability
To the fullest extent permitted by law, KidTalks Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our services
- Any unauthorized access to or use of our servers or personal information
- Any interruption or cessation of our services
- Any errors or omissions in course content
13. Copyright and DMCA Compliance
We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our services, please notify us by providing our copyright agent with the following information:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and where it is located
- Your contact information (address, telephone number, and email address)
- A statement that you have a good faith belief that use of the material is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act
- Your physical or electronic signature

16. Changes to Terms
We may update these Terms of Use from time to time. The updated version will be indicated by an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the new terms.
17. Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use. Upon termination, your right to use the services will immediately cease.
18. Governing Law and Venue
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California and the federal laws of the United States, without regard to conflict of law provisions. Any arbitration proceedings shall be seated in California.
